These Terms of Use ("Terms") govern your use of the Pout mobile application ("Pout", "the app") provided by Kratzer & Co (ABN 35645362865), Australia ("we", "us", "our"). By downloading or using Pout, you agree to these Terms. If you do not agree, please do not use the app.
Pout is a photo organisation tool that sits on top of Apple Photos. It helps you identify and file photos and videos that have not yet been added to your user-created albums. Pout uses Apple's PhotoKit framework to read your library and to add photos to albums at your direction. Pout does not replace Apple Photos and does not create separate copies of your media.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Pout on Apple devices that you own or control, in accordance with these Terms and the Apple App Store Terms of Service.
When you choose to delete an item in Pout, it is removed using the standard iOS system flow and placed in your Apple Photos Recently Deleted album, where it can be recovered within Apple's standard retention window. You are solely responsible for confirming deletions.
Please back up your photos. Pout is an organisation tool. While it is designed to work safely through Apple's own PhotoKit framework and never to copy or move your files off-device, you should always keep an independent backup of your library. We are not responsible for any loss of photos.
Pout has no accounts, no servers, and no cloud. It does not upload, duplicate, collect, or track your data. Your use of Pout is also governed by our Privacy Policy.
If any paid features or in-app purchases are offered, they are processed through the Apple App Store and are subject to Apple's billing terms. Refunds for App Store purchases are handled by Apple in accordance with Apple's policies.
Pout, its name, logo, design, and software are owned by Kratzer & Co and protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you. Your photos and videos remain entirely yours.
Pout is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or free of defects, or that it will meet your requirements. Nothing in these Terms excludes rights you may have under the Australian Consumer Law or other mandatory laws that cannot be excluded.
To the maximum extent permitted by law, Kratzer & Co will not be liable for any indirect, incidental, special, or consequential loss, or for any loss of data or photos, arising from your use of or inability to use Pout. Where liability cannot be excluded, it is limited to the amount you paid for the app (if any).
These Terms are between you and Kratzer & Co, not with Apple. Apple is not responsible for Pout or its content. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) to you; Apple has no other warranty obligation with respect to Pout. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
We may update these Terms from time to time. The current version will always be available at this page. Continued use of Pout after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of South Australia, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state, without limiting any mandatory consumer protections available to you.
